According to the German Mediation Act, mediation is a confidential procedure in which the parties, with the help of the mediator, seek a consensual settlement of their conflict.
Mediation has many advantages:
- It is a fast and inexpensive process.
- It is strictly confidential.
- The atmosphere is quiet and relaxed outside a courtroom.
- The solution is sustainable since the parties develop it together to mutual satisfaction with the help of the mediator. The parties take a decision, not a court.
- By touching upon all relevant issues and problems a win-win situation can be created.
- Mediation concentrates on the interests of the parties and what is really important to them, not on positions or formalities.
- Business or personal relations that may have existed for a long time are maintained or restored, whilst a court case often marks the end of a relationship.
Having faith in the justice of a judge is good. Responsibly developing an agreement is better.
